Brexit & CE Marking Update (September 2017)

UPDATE: In the early hours of the morning of the 12th September, the European Union (Withdrawal) Bill passed its first vote in the House of Commons. The aim of the Bill is to end the supremacy of EU law in the UK by converting all existing EU laws into UK laws. So how will this affect your CE Marking Obligations?

In the short term, the answer to that question is very little; The majority of CE Marking legislation is embodied into UK law by means of UK legislation and therefore won’t be subject to the ‘Great Repeal Act’. Where the legislation is subject to EU law (Construction Products and the new Medical Devices Regulations), the act will transpose those laws ‘verbatim’ into UK legislation.

As yet, we are not aware of any plans in the UK to amend Product Compliance legislation post-Brexit, although it should be noted that product compliance requirements for UK businesses exporting goods into the EU will remain unchanged. There will, however be some facets of the process that will require clarification upon the UK exiting the EU such as the role of Notified Bodies within the UK.
